The objective of this paper is to address the phenomenon of alterity in the philosophy of Maurice Merleau-Ponty, a problem that remained unsolved in Husserl’s phenomenology. One of the strategies implemented by Merleau-Ponty in order to establish “normality” in the interaction among human beings is to re-contextualize the concepts of body and perception. Strictly speaking, it could then be said that body and world intersect and remain connected through perception.

Journal of Mathematical Logic, Ahead of Print. Given a structure [math] and a stably embedded [math]-definable set [math], we prove tameness preservation results when enriching the induced structure on [math] by some further structure [math]. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

Mental body-representations are highly plastic and can be modified after brief exposure to unexpected sensory feedback. While the role of vision, touch and proprioception in shaping body-representations has been highlighted by many studies, the auditory influences on mental body-representations remain poorly understood. Changes in body-representations by the manipulation of natural sounds produced when one's body impacts on surfaces have recently been evidenced. But will these changes also occur with non-naturalistic sounds, which provide no information about the impact produced by or (...) on the body? Drawing on the well-documented capacity of dynamic changes in pitch to elicit impressions of motion along the vertical plane and of changes in object size, we asked participants to pull on their right index fingertip with their left hand while they were presented with brief sounds of rising, falling or constant pitches, and in the absence of visual information of their hands. Results show an "auditory Pinocchio" effect, with participants feeling and estimating their finger to be longer after the rising pitch condition. These results provide the first evidence that sounds that are not indicative of veridical movement, such as non-naturalistic sounds, can induce a Pinocchio-like change in body-representation when arbitrarily paired with a bodily action. How do we acquire a mental representation of our own face? Recently, synchronous, but not asynchronous, interpersonal multisensory stimulation between one’s own and another person’s face has been used to evoke changes in self-identification. We investigated the conscious experience of these changes with principal component analyses that revealed that while the conscious experience during synchronous IMS focused on resemblance and similarity with the other’s face, during asynchronous IMS it focused on multisensory stimulation. Analyses of the identified common factor structure revealed (...) significant quantitative differences between synchronous and asynchronous IMS on self-identification and perceived similarity with the other’s face. Experiment 2 revealed that participants with lower interoceptive sensitivity experienced stronger enfacement illusion. Overall, self-identification and body-ownership rely on similar basic mechanisms of multisensory integration, but the effects of multisensory input on their experience are qualitatively different, possibly underlying the face’s unique role as a marker of selfhood. Este artículo se centra en un aspecto comparativamente poco estudiado de la literatura sobre comunicación política en México relativo al análisis de los cambios significativos en la organización, las tácticas y las estrategias de campaña del Partido Revolucionario Institucional en elecciones presidenciales que han ocurrido durante las últimas dos décadas, y explora sus causas. El estudio muestra que la profesionalización e hibridación de las campañas del PRI no sólo dependió de cambios estructurales a gran escala en el sistema político y (...) en el sistema de medios de comunicación durante los noventas, sino también de los recursos y las características organizativas del partido. De modo tal que pueda ponerse en evidencia el carácter intersubjetivo que subyace tanto en los planteos de la teoría de la justicia de Rawls como en la ética del discurso habermasiana. Lo anterior, (...) en efecto, implica un ejercicio conceptual que decanta en el esclarecimiento de dos sendas argumentativas, ambas herederas de una interpretación de Kant, encauzadas a dar solución a la fundamentación de principios morales en las sociedades plurales contemporáneas. Research has found that both cisgender and transgender androphilic males (i.e., males sexually attracted to and aroused by other adult males) have female-typical occupational preferences when compared with gynephilic males (i.e., males sexually attracted to and aroused by adult females). Moreover, whereas cisgender androphilic males’ occupational preferences tend to be intermediate between those of gynephilic men and androphilic women, transgender androphilic males tend to have occupational preferences that are more similar to androphilic women. No study has directly compared both types (...) of androphilic males within the same culture. The present study investigated occupational preference and its relation to childhood sex-atypical behavior (CSAB), among gynephilic men (_n_ = 208), androphilic women (_n_ = 138), and cisgender (_n_ = 132) and transgender (_n_ = 129) androphilic males from the Istmo region of Oaxaca, Mexico, where androphilic males are recognized as third gender, _muxes_. The study found large sex differences in occupational preferences (_d_ = 2.80). Furthermore, both cisgender _muxe nguiiu_ (_d_ = 2.36) and transgender _muxe gunaa_ (_d_ = 3.44) reported having more sex-atypical occupational preferences compared with men. However, _muxe gunaa_ reported higher female-typical occupational preferences than women (_d_ = 0.59) and _muxe nguiiu_ (_d_ = 0.57), whereas _muxe nguiiu_ and women did not differ (_d_ = 0.08). These findings are consistent with the conclusion that sex-atypical occupational preferences are a cross-culturally universal aspect of male androphilia. Finally, CSAB was associated with sex-atypical occupational preferences among all participants. These findings suggest that a developmental continuity exists between childhood and adulthood sex-atypicality. (shrink)

This discussion of pride, shame, and guilt centers on the beliefs involved in the experience of any of these emotions. Through a detailed study, the author demonstrates how these beliefs are alike--in that they are all directed towards the self--and how they differ. The experience of these three emotions are illustrated by examples taken from English literature. These concrete cases supply a context for study and indicate the complexity of the situations in which these emotions usually occur.

We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. Se analizan las relaciones entre religión y nacionalismo en el marco de las conmemoraciones del Bicentenario de la República de Chile. Para ello observamos la fiesta de Ayquina, al interior de Calama. Prestamos atención a uno de los bailes, en este caso el Marinero que junto al baile Huaso simbolizan al nacionalismo. Recalcamos el doble elemento simbólico de este tipo de baile. Por un lado, representan la idea de una chilenidad, en este caso militar, y, por otro, siguen la lógica (...) andina de los santuarios del Norte Grande, en la que el bailar y cantar a la Virgen es lo fundamental. The relationships between nationalism and religion are analyzed in the context of Chilean republic’s bicentennial commemoration. To that purpose, the Ayquina festivity is observed. Attention is focused on el Marinero , a dancing expression which, together with the Huaso, symbolizes nationalism. The double symbolic element is stressed in this type of dance. On the one hand, it represents the idea of being a Chilean in the military forces and, on the other hand, it depicts the Andean logic of the Northern sanctuaries where dancing andsinging and paying tribute to the virgin are fundamental. Una de las características de la función jurisdiccional, como potestad-poder del Estado, es la interpretación del ordenamiento jurídico y aplicarlo a la resolución de un caso concreto; es decir, el juez, al momento de impartir justicia, deberá realizar un análisis de la norma jurídica que pretende aplicar para dotarla de un sentido concreto y práctico. Es por ello que se puede afirmar que la interpretación judicial cumple una función innovadora del derecho, ya que el juez con éstas al dictar sentencia, (...) puede modificar el ordenamiento jurídico. El presente trabajo tiene como fin exponer que, por vía jurisprudencial, la Sala Constitucional del Tribunal Supremo de Justicia consideró necesaria la creación de un recurso autónomo de interpretación de normas constitucionales, lo cual trajo como consecuencia inmediata, la desestabilización de nuestro estado de derecho. This work aims to show that the Constitutional Division of the Supreme Court of Justice deemed necessary to create, by means of jurisprudence, an autonomous recourse of constitutional norm interpretation, which nevertheless has no legal grip whatsoever. This study focuses on eugenics in Spain, and more specifically on the ‘official’ eugenics whose platform was the Primeras Jornadas Eugénicas Españolas . The aim of this paper is to relate eugenics to ‘governmentality’ rather than to State politics alone and to ‘Latin eugenics’ rather than to ‘mainline eugenics’. On the one hand, the FSED were largely centred on the development of a new sexual code which would set Catholic sexual morality aside. For this reason, sexual pedagogy was one of (...) the most relevant topics during the FSED, personal responsibility becoming the first step to social change. The concern about making people play an active role in their own self-regulation is typical of governmentality. The latter refers to societies where power is decentered and where the objective is to structure the field of action of others . On the other hand, the FSED emphasised preventive eugenics such as welfare programmes and health campaigns rather than negative eugenics such as the sterilisation of the unfit. The situation in Spain was mirrored in countries such as Brazil, Argentina and Mexico, which allows us to think about them in terms of ‘Latin eugenics’ rather than ‘mainline eugenics’ from countries such as Great Britain, Germany and the USA. Dentro de sepulcros llenos de fuego, deberían estar los miembros de todas las sectas y también los seguidores de Epicuro, que era conocido a través de Cicerón. En realidad, (...) el poeta pone en evidencia a connotados gibelinos. Habla con Farinata degli Uberti e interviene también el padre de Guido Cavalcanti, al que da una ambigua respuesta que, en mi opinión, es un rayo de esperanza para uno que es tachado de sostener la “opinión de los epicúreos”. Más bien podría ser un averroísta, lo que acomuna a todo un grupo de intelectuales de la época que niegan la inmortalidad del alma.: Not only Plato and Aristotle are remembered in the communal Firenze. Epicurus also, mentioned by Dante, Boccaccio and Villani. But was there a Florentinian Epicureism? In their imaginary trip from the Commedia, Dante and Virgil -with divine help- manage to enter Ditis City, where the heretical are. In tombs full of fire, should be members of all sects and also the followers of Epicurus, who was known through Cicero. In fact, the poet brings out notorious Ghibellines. El artículo recorre la obra de Rodolfo Kusch posicionando sus principales propuestas en la construcción de tres enfoques convergentes en su filosofía. El primer enfoque está relacionado con la fenomenología y la cultura. El segundo enfoque se refiere a la influencia de la antropología y el cuestionamiento por el símbolo. El tercer enfoque despliega una aproximación filosófico-política. Estos enfoques permiten introducir tres “horizontes de pregunta” principalmente relacionados con el método, con lo popular y con lo indígena, que son expuestos como (...) asuntos centrales en toda su obra. Estos “horizontes de pregunta” buscan comprender los alcances de la filosofía de Kusch y su contribución al pensamiento filosófico americano. This paper analyses the work of Rodolfo Kusch remarking his main philosophical proposals through three correlated perspectives. The first perspective refers to phenomenology and culture. The second focuses on the influence of anthropology and the problem of symbols. The third posits a political-philosophical approximation. These perspectives operate interdependently as the background for Kusch’s philosophy and allow us to introduce three “questioning horizons” related to the method, the popular and the indigenous as the central issues of his philosophical work. Thus, these “questioning horizons” build a platform to understand Kusch’s philosophy and his contribution to the Latin American philosophy. (shrink)

Muchos entienden el tema de los derechos humanos y de las garantías como una conquista de las sociedades modernas, una manera de pensar ligada a la Ilustración y a los movimientos que surgieron bajo el seno de la Revolución Francesa. Por ende, se ve en las civilizaciones antiguas una especie de época no evolucionada sobre estas materias, una época en que la barbarie y la sinrazón parecieran hablar más que la cordura. Sin embargo, existieron civilizaciones antiguas que nada envidiarían a (...) sociedades modernas basadas en legislaciones que sustentan los derechos humanos como bandera de lucha y broche de distinción. Una de estas civilizaciones es la hebrea, y su legislación es la ley mosaica.El presente artículo tiene por finalidad resolver si la legislación mosaica tuvo un estatuto conveniente en materia de derechos humanos, si éstos efectivamente se consagraban y respetaban, siendo la ley no sólo prescripciones en este sentido sino además un posible régimen garantista de dichos derechos. Por consecuencia, se busca rastrear una posible constitucionalidad en el sistema mosaico y, finalmente, un régimen penal y procesal penal de garantías. (shrink)

La reflexión en materia penal ha sido centrada, específicamente, en ciertos discursos considerados “oficiales”, entre los que se consideran los pensamientos ilustrados. Desde ahí arrancan las concepciones modernas acerca del sistema penal europeo, y en gran parte, las legislaciones actuales sobre la materia en el mundo occidental. Sin embargo, no todo el pensamiento penal tiene por canónicas las consideraciones penales ilustradas ni las concepciones clásicas sobre el derecho penal. El presente artículo tiene por finalidad exponer un pensamiento crítico del sistema (...) penal europeo, tanto de sus raíces iluministas, como de su herencia en las sociedades occidentales contemporáneas. Este pensamiento es el del filósofo y psicólogo francés Michel Foucault. Las críticas, interpretaciones y sospechas que el autor arroja, bien pueden ser consideradas en el hoy, sobre todo si pensamos en la resurrección desde la década del 80 y 90 del siglo pasado, de concepciones que hacen resurgir los modelos ilustrados que en el derecho penal se han producido, reconociéndose la escuela del derecho penal mínimo como su máxima tributaria. Esto de algún modo ha incidido a su vez en el pensamiento penal en Chile y su derecho. (shrink)

El trabajo del autor analiza el pensamiento penal del filósofo alemán Friedrich Nietzsche, de cómo las normas penales poseen un sustento moral, y cómo la pena es una de las formas de grabar con fuego los deberes que impone la moral. Además, Nietzsche arroja sus sospechas sobre el contrato social como forma de constituir la sociedad y cuestiona las bases de la relación Estado-delincuente bajo el pacto social. Sin embargo, fuera de negar la idea de dicho pacto como creador del (...) Estado, considera propositivamente, una forma de Estado y un derecho penal diverso. Esto representa, a juicio del autor, un momento dialéctico positivo. Señala el autor en adición, cómo el pensamiento nietzscheano es propicio en la reflexión latinoamericana; en primer lugar, por fijar el contenido de lo europeo con mayor precisión, para que el pensamiento latinoamericano sepa de qué habrá de diferenciarse con aquel; en segundo lugar, por la aplicación de la genealogía de la penalidad a la historia nuestras propias instituciones. La constitución dogmática sobre la Iglesia del concilio Vaticano II profundiza en las relaciones entre la Tercera Persona de la Santísima Trinidad y la Virgen María. La santidad original de la Virgen, formada por el Espíritu Santo como nueva criatura, requerirá de ella una actitud activa y consciente, como colaboradora única en su obra. De este modo, la Madre de Dios aparece con las notas de “Casa de Dios”, “Theotokos” y “Madre de la Iglesia”. La obra de H. This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

Those who wish to claim that all facts about grounding are themselves grounded (“the meta-grounding thesis”) must defend against the charge that such a claim leads to infinite regress and violates the well-foundedness of ground. In this paper, we defend. First, we explore three distinct but related notions of “well-founded”, which are often conflated, and three corresponding notions of infinite regress. We explore the entailment relations between these notions. We conclude that the meta-grounding thesis need not lead to tension with (...) any of the three notions of “well-founded”. Finally, we explore the details of and motivations for further conditions on ground that one might add to generate a conflict between the meta-grounding thesis and a well-founded constraint. We explore these topics by developing and utilizing a formal framework based on the notion of a grounding structure. (shrink)

En el presente artículo se analiza las posibilidades de la teoría de las Representaciones Sociales (RS) para, desde la perspectiva de los sujetos, analizar los elementos cognitivos implicados y socialmente construidos que sustentan las acciones de gestión micro y macro institucional, y de coordinación entre varias municipalidades de un mismo territorio, lo que la literatura de gestión denomina trabajo asociativo o asociativismo. Interesan específicamente las representaciones sociales de la asociatividad en el tema educativo, desde actores político-administrativos y profesionales implicados en (...) la mejora de la educación municipal. Se postula y fundamenta que el estudio de las Representaciones Sociales del Asociativismo Municipal en Educación es pertinente desde los elementos conceptuales de la perspectiva Procesual, dado que el objeto de Representación –el Asociativismo Municipal en Educación- y las técnicas para su análisis se ajustan a las estrategias de implementación del trabajo asociativo en los distintos niveles de organización municipal en el tema educativo. A veinticinco años de la publicación en Social Text del artículo que da inicio al escándalo Sokal, este trabajo hace una evaluación del caso desde cuatro perspectivas. En la primera parte se analizan los argumentos a favor y en contra del escándalo y de lo que sostiene Sokal con respecto a cierto tipo de estudios en Humanidades. La segunda hace un recuento de casos similares que anteceden y suceden al escándalo. La tercera evalúa la recepción del caso en Francia a (...) partir de una tradición que ha sido esquiva a la Filosofía analítica en ese país, tanto intelectual como institucionalmente. Este artículo propone una aproximación crítica al concepto de femicidio. Se repasa su origen y las diferentes versiones desarrolladas por su proponente, Diana Russell, a más de algunas otras alternativas de la definición. Se realiza una aproximación analítica al mismo, y se revisan sus cualidades intensionales y connotativas. El artículo hace un análisis del discurso de Beccaria contenido en su libro Dei delitti e delle pene y extrae las ideas relativas a la percepción como argumento considerable dentro de su propuesta político-criminal para fundar la utilización de ciertos instrumentos de la penalidad, con base en su pensamiento sobre la estética, entendida como un estudio sobre la percepción, realizado en algunas investigaciones personales. Igualmente, toma ciertas ideas de la epistemología gravitante de la época, para fundar su desiderátum político-criminal.

Gabriel Richardson Lear presents a bold new approach to one of the enduring debates about Aristotle's Nicomachean Ethics: the controversy about whether it coherently argues that the best life for humans is one devoted to a single activity, namely philosophical contemplation. Many scholars oppose this reading because the bulk of the Ethics is devoted to various moral virtues--courage and generosity, for example--that are not in any obvious way either manifestations of philosophical contemplation or subordinated to it. They argue that (...) Aristotle was inconsistent, and that we should not try to read the entire Ethics as an attempt to flesh out the notion that the best life aims at the "monistic good" of contemplation. In defending the unity and coherence of the Ethics, Lear argues that, in Aristotle's view, we may act for the sake of an end not just by instrumentally bringing it about but also by approximating it. She then argues that, for Aristotle, the excellent rational activity of moral virtue is an approximation of theoretical contemplation. Thus, the happiest person chooses moral virtue as an approximation of contemplation in practical life. Richardson Lear bolsters this interpretation by examining three moral virtues--courage, temperance, and greatness of soul--and the way they are fine. Elegantly written and rigorously argued, this is a major contribution to our understanding of a central issue in Aristotle's moral philosophy. (shrink)

El Estado de Hegel es el Estado de Derecho. Sin embargo en su Filosofía del Derecho se encuentran fundamentos decisivos para una teoría del Estado Social. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. A este problema la sociedad es incapaz de darle una solución. (shrink)
